Ken Oliphant pursues research on a wide-ranging set of topics relating to English, European and comparative tort law, and compensation for incapacity. His current research projects include the following:

  • A Socio-Legal Analysis of Personal Injury Claims (principal investigator). This externally funded project, conducted on behalf of the Institute for European Tort Law (ETL), breaks new ground by applying a sociological approach to the analysis of the personal injury claims process in three contrasting European countries. It seeks to establish how applicable norms found in legal texts are translated into practice and to subject the transformations that occur to critical analysis.
  • National Court Practice and European Tort Law (Digest Project) III: Misconduct (joint project leader). This is the third instalment of one of ETL’s ‘flagship’ projects, the Digest of European Tort Law. Previous instalments addressed Natural Causation and Damage. The series aims to provide guidance for an organic convergence of tort law in Europe by identifying an acquis commun in the continent’s multiple legal systems. The project is funded by grant from Austrian Science Fund.
